It is also of the utmost importance to first establish that the name/trademark will not infringe upon the rights of others. Injunctions, damage claims and other potential legal disputes will effectively torpedo a new product launch and represent a risk to business.
In a comprehensive trademark search (similarity examination) we investigate potential obstacles to registration and use. We examine trademarks registered and trademark applications submitted in Finland, international registrations designating Finland, EU trademark registrations and applications, Finnish company names and surnames in use in Finland. We also assess the level of distinctiveness of the trademark.
In a limited trademark search (identity examination) we investigate absolute obstacles to registration, identical trademarks and clear lack of distinctive character of a trademark. This is not a comprehensive search, so it can only be used as a preliminary examination prior to submitting an application. It should not be used if you intend on putting the trademark into immediate use.
Choosing the right trademark is even more difficult for companies that operate over an extensive geographical area. We will help you ensure that your intended trademark will meet all the requirements to serve as an international trademark. We offer expert assistance in choosing a trademark as well as planning a trademark strategy from a protection standpoint.
Effective protection is like a jigsaw puzzle, as the various forms of protection complement one another. Take advantage of our expert experience in choosing forms of protection and how to proceed.
